These Terms and Conditions set out the basis on which Rubbish Clearance West Hampstead provides rubbish clearance and waste collection services to domestic and commercial customers. By making a booking, using our services, or allowing our operatives access to your premises, you agree to be bound by these Terms and Conditions.

1. Definitions

2.2 We reserve the right to refuse to collect certain items, including but not limited to hazardous waste, clinical or medical waste, asbestos, gas bottles, chemicals, flammable or explosive materials, and any waste that we reasonably believe may pose a risk to health, safety, property, or the environment.

2.3 We may at our discretion agree in writing to collect specific items outside our standard service scope, subject to additional charges and compliance with applicable regulations.

3. Booking Process

3.1 Bookings can be made by telephone, email, or through any booking system that we may operate from time to time.

3.2 You are responsible for providing accurate and complete information at the time of booking, including the type and estimated volume of waste, access details for the premises, and any relevant restrictions such as parking limitations or time constraints.

3.3 Any quotation provided before the collection is based on the information you supply. If the actual volume, weight, or nature of the waste is different from that described at the time of booking, we reserve the right to adjust the price or refuse to proceed with the collection.

3.4 Bookings are subject to availability. We will use reasonable efforts to attend at the agreed date and time but do not guarantee arrival times. Any timeslot provided is an estimate only and may be affected by traffic, weather, or operational factors.

3.5 We may request photographic evidence of the waste before confirming your booking, especially for larger clearances or where there is uncertainty about the type of items to be removed.

4. Access and Parking

4.1 You must ensure that our operatives have safe, suitable, and reasonable access to the premises and the waste to be collected. This includes arranging any necessary permissions for access to private roads, car parks, or communal areas.

4.2 You are responsible for securing any parking permits, visitor passes, or other permissions required to allow our vehicles to park close enough to the premises for the safe and efficient performance of the Services.

4.3 If suitable parking is not available, or if access is restricted, we may not be able to carry out the Services as planned. In such circumstances, we may charge a call-out fee or a reasonable waiting charge, or we may cancel the booking and apply a cancellation charge as set out in these Terms and Conditions.

4.4 If our operatives consider that access to the premises or the waste presents a health and safety risk, they may refuse to proceed with part or all of the work. This includes but is not limited to unsafe structures, aggressive animals, or hazardous materials on site.

5. Pricing and Quotations

5.1 Our charges may be based on one or a combination of volume, weight, type of waste, labour time, access difficulty, and disposal costs.

5.2 Any quotation given before collection is an estimate only and may be revised on site once our operatives have inspected the waste and access arrangements.

5.3 If the price needs to be revised, our operatives will inform you before starting the work. If you choose not to proceed on the revised price, we reserve the right to charge a call-out or attendance fee to cover our reasonable costs.

5.4 All prices are stated in pounds sterling and are exclusive of VAT unless expressly stated otherwise.

5.5 We reserve the right to change our prices at any time. Changes will not affect bookings that have already been confirmed, except where the information you provided was inaccurate or incomplete.

6. Payments

6.1 Payment is due in full on completion of the Services, unless otherwise agreed in writing in advance.

6.2 We accept common payment methods such as cash, debit or credit card, or bank transfer, subject to availability and any limits we may impose.

6.3 For business customers and regular waste collection arrangements, we may agree credit terms at our discretion. In such cases, invoices are payable within the period stated on the invoice. If no period is stated, payment is due within 14 days of the invoice date.

6.4 If you fail to make payment when due, we may charge interest on overdue sums at the statutory rate allowed under UK law, accruing daily until payment is received in full. You will also be responsible for any reasonable costs we incur in recovering overdue amounts, including legal fees and debt collection charges.

6.5 We reserve the right to suspend or refuse further Services to you if your account is in arrears or if you have previously failed to pay invoices on time.

7. Cancellations and Amendments

7.1 You may cancel or amend a booking by notifying us by telephone or email.

7.2 If you cancel more than 24 hours before the scheduled arrival time, no cancellation charge will normally apply.

7.3 If you cancel less than 24 hours before the scheduled arrival time, or if you are not present at the premises when our operatives arrive and cannot gain access, we reserve the right to charge a cancellation or call-out fee to cover our reasonable costs.

7.4 If you wish to change the date, time, or scope of the Services, we will use reasonable efforts to accommodate your request, subject to availability. Changes may affect the price and may be treated as a cancellation and rebooking at our discretion.

7.5 We may cancel or rearrange a booking if we are unable to provide the Services due to circumstances beyond our reasonable control, such as severe weather, vehicle breakdowns, accidents, or staff illness. In such cases, we will not be liable for any resulting losses, but we will refund any prepayments for Services not provided or reschedule at a mutually convenient time.

8. Waste Ownership and Disposal

8.1 By presenting waste for collection, you confirm that you are the owner of the waste or have the authority of the owner to arrange its removal.

8.2 Once the waste has been loaded onto our vehicle and payment has been made or agreed, ownership of the waste transfers to us. We will then be responsible for its transportation and disposal in accordance with applicable waste regulations.

8.3 We will dispose of waste at licensed or authorised facilities and will use reasonable endeavours to recycle materials where practicable, in line with environmental best practice.

8.4 You must not ask our operatives to dispose of waste in an unlawful manner, such as leaving items on public land or fly-tipping. We will not comply with any such requests.

9. Compliance with Waste Regulations

9.1 We operate in accordance with relevant UK waste legislation and regulations, including duties relating to the collection, transport, and disposal of controlled waste.

9.2 We may issue you with documentation relating to the transfer of waste, including a waste transfer note where required. You must retain any such documentation in accordance with your legal obligations.

9.3 You are responsible for accurately describing the type and nature of the waste at the time of booking and collection. If waste is found to contain prohibited or hazardous materials that you did not disclose, you may be liable for additional charges, penalties, or the cost of specialist disposal.

9.4 We reserve the right to report any suspected unlawful activity relating to waste, including fly-tipping or the presentation of hazardous materials, to the relevant authorities.

10. Your Responsibilities

10.1 You must ensure that the waste to be collected is clearly separated from any items that are not to be removed. Our operatives will use reasonable care, but we will not be liable for removing items that you have not clearly identified as excluded from the clearance.

10.2 You must secure any valuables, personal items, documents, or items of sentimental value before our operatives begin work. We cannot accept responsibility for the loss or damage of such items if they are mixed with waste intended for removal.

10.3 You must ensure that the premises are reasonably safe for our operatives to work in, including taking steps to manage risks such as loose floorboards, exposed nails, or other hazards.

10.4 Where waste must be moved from inside a property, loft, basement, or garden, you must disclose any access issues or obstacles at the time of booking.

11. Our Liability

11.1 We will exercise reasonable care and skill in providing the Services.

11.2 Nothing in these Terms and Conditions limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other matter that cannot be excluded or limited by law.

11.3 Subject to the above, we will not be liable for any indirect, consequential, or special losses, including loss of profit, loss of business, loss of opportunity, or loss of data, arising out of or in connection with the Services or these Terms and Conditions.

11.4 Our total liability to you for any direct loss or damage arising out of or in connection with the Services and these Terms and Conditions, whether in contract, tort, or otherwise, shall be limited to the total amount paid or payable by you for the specific Services giving rise to the claim.

11.5 We are not liable for any pre-existing damage to your property or for any defects unrelated to the actions of our operatives. You must notify us in writing of any alleged damage caused by our Services within 48 hours of completion, providing reasonable evidence where possible.

11.6 We will not be responsible for delay or failure to perform our obligations where such delay or failure is due to events beyond our reasonable control, including but not limited to extreme weather, strikes, emergencies, or interruptions to transport or utilities.

12. Insurance

12.1 We maintain appropriate public liability insurance and other cover relevant to our waste collection and rubbish clearance activities.

12.2 Our insurance arrangements do not reduce or extend our liability as set out in these Terms and Conditions or as limited by law.

13. Complaints

13.1 If you are dissatisfied with any aspect of the Services, you should contact us as soon as reasonably possible so that we can try to resolve the issue.

13.2 Complaints should be made by telephone or email, providing your name, contact details, the service date, and a clear description of the issue.

13.3 We will investigate complaints in a fair and timely manner and may request additional information or evidence from you.

14. Data Protection and Privacy

14.1 We will collect and use your personal information only for the purpose of administering bookings, providing the Services, handling payments, and managing our relationship with you.

14.2 We may also use your details for administrative and legal purposes, including the prevention and detection of fraud or abuse of our services, and to comply with our legal obligations.

14.3 We will take reasonable measures to protect the security and confidentiality of your personal information in accordance with applicable data protection laws.

15. Variations to Terms

15.1 We may amend these Terms and Conditions from time to time. Any updated version will apply to new bookings made after the date of publication of the revised terms.

16. Severability

16.1 If any provision of these Terms and Conditions is held to be invalid, illegal, or unenforceable by a court or competent authority, that provision shall be deemed deleted, but the remaining provisions shall remain in full force and effect.

17. Governing Law and Jurisdiction

17.1 These Terms and Conditions and any dispute or claim arising out of or in connection with them, or with the provision of our rubbish clearance and waste collection services, shall be governed by and construed in accordance with the laws of England and Wales.

17.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Services.
